            THIS MATTER is before the Court on the defendant, Roy Gaber’s, appeal from a judgment and sentence entered by the Pinellas County Court. The discrepancy between the offense date alleged in the charging document and the date proved at trial is insufficient to justify granting a motion for judgment of acquittal under the circumstances of this case. See Sanchez v. State, 956 So.2d 1261 ( Fla. 4^th DCA 2007). The trial court was correct to deny the defendant’s motion for judgment of acquittal.

            IT IS THEREFORE ORDERED that this Court affirms the judgment and sentence.
